***UPDATE #1***

February 20th, 1999:

Just got word that the doctor we sued 9 years ago is finally being sued for his license from the Attorney General's office (I got a copy of the complaint from my attorney)...about damn time for this too, so I have been celebrating this much so far.  Can't wait to hear more on how this suit will go!!!  This doctor currently has more than 22 lawsuits against him since 1985 and in 1996 he committed fraud by lying on his renewal for his license, which sparked an undercover investigation by the local news team about doctors who slip through the cracks and not getting caught and reprimanded....in turn, the news team approached the AG about this as that is where all the lawsuits go to.  In the news story, the Attorney General at the time knew nothing about this (but his office sure did), so he said he would look into it and conduct his own investigation.
This doctor was denied hospital priviledges in obstetrics in December 1995 and they reinstated him in April 1996 if he agreed to follow a few conditions..one being to have a backup when he failed to intervene in the delivery room (which he did not have with me).  Well..he failed that in April 1997 taking yet another baby (and almost the mother too)who's case was so similar to mine.  We were listed as the 2nd suit on the complaint.  I cannot believe the hospital even allowed him to return with the mental state he was still in.  It was as if he had a vendetta out on women and took it out on those that had nothing to do with his scorn.  Several nurses refused to assist in any of this doctor's patients, yet the hospital continued to employ him.  4 months just isn't all that much time to get cured from whatever his mental problems are which have been a problem for well over 10 years.  When we filed, he had already had 13 lawsuits 4 of them active (2 of those were scenario to mine).  Several victims hated to even press a suit against him because they eventually found out that it would be hard to put a doctor out of practice just from theirs alone.  A medical malpractice suit constantly reminds the victims of what they endured (trust me, I know..hehehe), and when a doctor is punished by a slap on the wrist with each settlement of these suits and no reprimand to the doctor, we (as victims) get soooo much more angry and discouraged.  Well..since getting word of this complaint, I am glad I did press one...but why did it take soooo long?  I'm also glad I did not take this doctor out myself when justice failed, because I would not want to spend time behind bars for something he did in the first place.  It has taken a lot out of me the last 9 years, but I am a survivor and have done what I could just so I can be here to  watch it all come full-circle!!!
This doctor and even the hospital has taken away not only our trust for the medical field, but also a part of our family.  This was not our first encounter with a negligent doctor...but it was the hardest.  I almost lost my husband, Matthew back in 1992 from a misdiagnosed ruptured appendix.  It was only through God's love and intervention that we survived this one where I son didn't. We probably would have pressed a suit on this too, but since we already had one in the works and the amount of emotional energy it took, we decided it just wouldn't be worth it.  We were just glad Matt survived and we counted our blessings once again!!! The only message I can relate to others from all of this is, check out your doctors thoroughly.  Course the majority of us
never find this out til it's been done to us.  It is all public knowledge, but the hard part is finding out where to go to find this knowledge which most consumers didn't. I didn't until after we started legal proceedings on our son's and my injury. I did however help 2 people out when I heard they were seeing this doctor and told them, if they had any history of difficult pregnancies or conditions that would require this doctor's immediate attention, do not go to this doctor.  They thanked me later!!!   With my husband, this was not an option.  He needed immediate attention.
I can tell you that when we moved to Maryland, we checked out all the doctors thoroughly..even the surgeons...and have found only the female ones the most caring, competent, less egotistical and comfortable for our needs. That's not to say no males are, but just the ones that we came up against even though they did not have a history of malpractice claims against them. It was their professionalism that was questionable rather than their practice..in other words in how they spoke to us when questioned about their expertise.  That was the same type of attitude that the male doctors in Indiana took away. In a way I'm glad for that part of it, cuz it seemed like we were magnets to these kind and still we thought we could trust doctors even in a different state.  Well..NO MORE...they're even here too!!!
Well..I thank you for your time in reading this!!!  My best therapy has been in talking since I haven't invested too much in shrinks either..hehehe.

Below is a letter I sent in regards to what I wrote to a website that has the malpractice cases listed for the State of Indiana

Dear Justice Denied,

I would like to contribute my story as I assumed that my medical malpractice case against Dr. M had also been a formal complaint as well with the Attorney General's Office of which I am just now finding out was not an actual complaint but just another malpractice suit with a settlement that just makes us ill when we found then that it would not put this physician out of practice as we had hoped. When we filed, there were no computers or people to turn to in finding out anything that surrounded doctors like these so were left to turn to an attorney once the crime was already committed to find out. In other words, we got the runaround in 1989 when we went searching for a doctor to handle our third pregnancy and child's delivery. Dr. M did formerly care for me in 1985 when I miscarried and the treatment I received then was outrageous. When I was in sooo much pain and felt like I was bleeding to death, I went to the ER and when they found out I was his patient, they said they couldn't touch me or give me anything for the pain and Dr. M refused to give me anything for the pain either. He said I had to wait until the next day to see him...rather than coming to find out just how much pain I was in and run tests at the hospital...which would have confirmed I was miscarrying then. Instead, he made me wait til the following morning...did a sonogram, which still showed I had a viable pregnancy, but nothing that resembled a baby as I was in my 16th week according to my calculations from my last menstral cycle, etc. He said he lost the first blood test and would need to go in search of it to verify I actually was losing the baby. Well, the pain had subsided, all bleeding stopped and I went to work the next day. That next day the doctor had the audacity to call me at work and confirm I was losing the baby rather than make an appointment for me to come see him. So there I was stuck at work balling my eyes out and had to get my boss to relieve me. He scheduled me to have a D & C done the following evening, but I told him I couldn't at that time cuz I had to go bowling..hehehe. Bowled the best game ever too. He was quite arrogant even then.

I moved to Virginia shortly after this and became pregnant again with our daughter, Leslie. When I had my initial exam there, the doctor asked me if I was going to keep this baby. I wondered why in the heck would he ever ask such a question. I said, "Why wouldn't I?" He stated it was just standard questions...and it was dismissed. (Later I would find out that Dr. M had put down that I had an elective abortion in my chart rather than a spontaneous miscarriage). The pregnancy ended with an emergency c-section because she was in distress. We had no hesitation whatsoever to go with the c-section. We returned to Indiana when Leslie was 6 months old and when I became pregnant with our second baby, I was in search of a doctor. Three of the mothers of the children I was caring for in my home-daycare said Dr. M was the best..as he delivered them all. I hesitated at first because I thought, well maybe he was just having a couple bad days back when I miscarried is all and with my hormones raging, I may have exaggerated a bit. Well my initial visit was a rather enlightening one. He had a copy of the post-operative report on Leslie, threw the report on his desk and said, "This was an unnecessary c-section". You can imagine how I reacted to that remark..and I proceeded to tell him why it was necessary. He never wrote anything I said to him either concerning that issue. He just continued to say I should try a VBAC with this one and I agreed on one condition..that if the baby was bigger than Leslie, then NO. (This is what my last OB/GYN informed me of).

I had a pretty rough pregnancy with Kyle with several kidney infections and a sinus infection with only temporary relief until the next infection. I later found out that I had a chemical embalance (but which he dismissed as me being a "wimp" quote unquote) which also caused me to start having labor contractions in my 5th month. Lori Rollins told me about your site. I never even thought to search on the web once I got a computer with internet access. I'm glad I did, so I can post my complaint against him too!!! Unfortunately, it is a little late. I'll leave this up to you whether or not you want to post it. To this day I have lost a lot of trust in most doctors all because of Dr. M and another physician who almost took my husband's life at the same hospital that employed both of them...that is another story entirely, but nonetheless true. We decided not to pursue the second claim because of the result we knew we would get..no license on either of them. It was just too emotional to start a new claim!!!

Medical Malpractice Convention in Chicago on August 29-31, 1998 was not a major success, but a chain of events occurred around the globe shortly after this. Maybe we made a difference there, that we will never know. We can only count our blessings that our voices are finally being heard!

Please click link above for the whole story of what one doctor can do to many people when a state overlooks him instead of listening to his victims' cries!! There are more like him out there but the public is not given sufficient enough information about the histories of them to know. Maybe now there will be more voices heard, that much I pray doesn't happen but rather that we can make them accountable for their actions as criminal and not malpractice any longer, especially for those repeat offenders who show a similar pattern which constitutes murder rather than malpractice!
